Theresa Marcotte regrets her decision to rent two heat pumps from Simply Green Home Services in 2020. The contract, which she didn’t fully read, included a monthly payment of $160 for 10 years, with the understanding that the company would provide maintenance and remove the equipment at the end of the contract. However, she recently discovered that the company had registered a notice of security interest (NOSI) on her property title, which gives the lender an interest in the equipment. This has caused problems when she tried to apply for a home equity loan. The NOSI is a common practice in New Brunswick, but it was recently banned in Ontario due to a class-action lawsuit. Marcotte is now faced with paying over $11,000 to remove the NOSIs or continuing to rent the equipment for the remainder of her contract. She feels scammed and is speaking out to warn others about the potential risks of NOSIs and the importance of reading contracts carefully.
